Lack of Landlord Knowledge Results In Eviction Problems Claim Accord Lets

New figures released by the eviction service Landlord Action claim that due to the amount of people in arrears with their rental payments, a backlog of those attending the small claims court means that it is taking nearly three months to get an initial hearing. Now Accord Lets, the regional property specialists, offering property to rent in Leamington, Birmingham and Warwickare highlighting the importance of renting through a reputable agent.

Resulting in more lost payments, an increased workload for the courts and a 15-year high in properties being repossessed, the economic woes are really starting to take their toll.

Mr Mimmack, from the firm who offer not just Birmingham apartments to let but property to rent in Leamington and Warwick property to let, said, “While the courts are clogging up, more and more landlords are missing out on lost rent, resulting in them struggling to pay their mortgages, which will give rise to more landlords encountering financial difficulty.

In the past year we have seen a marked increase in the amount of landlords contacting us in the areas of Leamington and Birmingham, because they are having problems evicting tenants due to problems with rental payments, and it just goes to show that there really is a problem here that needs to be addressed. As a lack of job security takes over and tenants begin to struggle financially, it is often the landlord who is left to pick up the pieces, after all, just having one tenant who is late with their rental payments can lead to the landlord experiencing mortgage arrears, which is bad news all round.”

Renting your property through a reputable agent will ensure that should the worst happen, you are in safe hands. Evicting a tenant without any prior experience or knowledge of the law can be tricky and you must first obtain a court order before any eviction can take place, you must also convince the small claims court that you have grounds for possession. In total there are 17 different grounds for possession under the Housing Act of 1988 (amended 1996), which can make the process rather tricky indeed.

Ground 8 covers any situation where the tenant has two month’s rent outstanding when the landlord serves them a notice, Ground 10 is where the tenant failed to pay part of his or her rent and Ground 11 is where there are persistent late rental payments.

“So many landlords choose to go it alone, and it can certainly be tempting to cut back in the current economic situation, but if something does go wrong with a tenant refusing to pay their rent, the landlord is alone, with a lack of knowledge and a long wait at the small claims court.
